Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the ServiceConnect PRO website at serviceconnectpro.com and all related services (collectively, the "Services") provided by ServiceConnect PRO ("we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

Description of Services

ServiceConnect PRO provides a foundational marketing infrastructure platform for home service contractors. Our Services include:

  • SEO-optimized website design and hosting
  • Lead management and unified inbox
  • Reputation management tools
  • Invoicing, estimates, and payment tools
  • Social media and email marketing tools
  • CRM usage credits
  • Optional add-on services (Managed SEO, AI Employee, Client Reactivation, Visitor Identity)

ServiceConnect PRO is a marketing infrastructure platform. We do not guarantee leads, rankings, revenue, or specific business results. Our platform prepares your business for marketing — it does not replace marketing execution.

Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms on behalf of yourself or your business. By using our Services, you represent and warrant that you meet these requirements.

Account and Access

When you sign up for ServiceConnect PRO, you are responsible for:

  • Providing accurate and complete information
  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Notifying us immediately of any unauthorized access

Pricing and Payment

  • Foundation plan: $599/month with a one-time $2,500 setup fee
  • CRM usage credits: $50/month included; overages billed directly to client card
  • Add-on services: Billed monthly at the rates specified at time of purchase

All fees are billed in U.S. dollars. We reserve the right to modify pricing with 30 days' written notice. Price changes do not apply retroactively.

Cancellation

ServiceConnect PRO subscriptions are month-to-month after the initial setup period. You may cancel at any time by contacting us. Upon cancellation:

  • Your access will continue through the end of the current billing period
  • Setup fees are non-refundable
  • You retain full ownership of your customer data with export access
  • There are no cancellation penalties or lock-in fees

Data Ownership

You retain full ownership of all customer data stored within your ServiceConnect PRO account. This includes contacts, leads, communications, and any data you import or generate through the platform.

You may export your data at any time. We will not sell, share, or use your customer data for purposes other than providing our Services to you.

SMS/Text Messaging Terms

If you opt in to receive SMS/text messages from ServiceConnect PRO:

  • You consent to receive marketing, transactional, and service-related text messages
  • Message frequency varies based on your interactions and preferences
  • Message and data rates may apply depending on your carrier and plan
  • You can opt out at any time by replying STOP to any message
  • Reply HELP for assistance
  • Your consent is not a condition of purchase

We do not sell or share your phone number or SMS consent with third parties for marketing purposes. See our Privacy Policy for more details.

TCPA Compliance: By opting in to receive text messages, you expressly consent to receive recurring automated marketing and non-marketing messages at the phone number provided. This consent is not required as a condition of purchasing any goods or services. You understand that message and data rates may apply.

Acceptable Use

You agree not to use our Services to:

  • Violate any applicable law or regulation
  • Send spam, unsolicited messages, or bulk communications in violation of anti-spam laws
  • Transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Infringe on any third party's intellectual property rights
  • Use the platform for any illegal, fraudulent, or deceptive purpose

We reserve the right to suspend or terminate your access for violation of these terms.

Intellectual Property

All content, branding, software, and materials on the ServiceConnect PRO website and platform are our property or the property of our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our content without our written permission.

Website Services

Websites built as part of your ServiceConnect PRO subscription are hosted and maintained on our platform. The website design and structure are created specifically for your business. While you own your business content and data, the underlying platform technology, templates, and code remain our property.

No Guarantees

ServiceConnect PRO provides tools and infrastructure to support your business. We explicitly do not guarantee:

  • Search engine rankings or placement
  • Specific lead volume or quality
  • Revenue increases or business growth
  • Return on investment

Results depend on many factors outside our control, including your market, competition, service quality, and how you use the platform.

Limitation of Liability

To the maximum extent permitted by law, ServiceConnect PRO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our Services.

Our total liability for any claim arising from these Terms or our Services shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify, defend, and hold harmless ServiceConnect PRO, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of our Services or violation of these Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions. Any legal proceedings shall take place in St. Tammany Parish, Louisiana.

Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, it shall be settled by binding arbitration administered in St. Tammany Parish, Louisiana in accordance with the rules of the American Arbitration Association (AAA).

The arbitration shall be conducted by a single arbitrator, and the decision of the arbitrator shall be final and binding. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against ServiceConnect PRO.

Small Claims Exception: Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and ServiceConnect PRO regarding the use of our Services. These Terms supersede any prior agreements, communications, or proposals, whether oral or written, between you and ServiceConnect PRO.

Waiver

The failure of ServiceConnect PRO to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by ServiceConnect PRO.

Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. ServiceConnect PRO may assign these Terms without restriction.

Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
